There are four major styles of punishment in the United States: Retribution, Deterrence, Rehabilitation, and Societal Protection. Research by Schultz & Allen (1967) shown: One of the interesting aspects in American society is the widespread belief that the whole range of violations of law, from reprehensible acts (mala in sc) to merely forbidden behaviors (niala prohibita), can equally be controlled by punishment. The problem is that attempts at deterre nce by punishment of both these types of crime are probably less effective than deterrence and control by other means. Retribution has been a form of punishment since biblical times. It has been a common way to punish someone with retaliation being the intent to the offender. Many Americans still agree to this form of punishment, while others feel that this does not help the criminal improve him/herself. Retribution is usually seen as the criminal is getting what they deserve. Crime deterrence is usually based on a theory that every individual is conscious of what is right and wrong and knowledgeable of the consequences of wrongful behavior. As John Miller (2008) explained: The familiar question of whether the death penalty is a crime deterrent has experienced a recent revival thanks to new analyses. In one sophisticated ...

Those committing similar crimes can expect similar retributions, but those offenders will likely experience very different rehabilitations (Macionis, 2006).     Wampler (2004) asserts that rehabilitation causes a decline in recidivism because the rehabilitated are more likely to find productive jobs within society. “Research has shown that a person who has advanced their education and received counseling while in prison is much less likely to return to prison than someone who has been idle during their incarceration” (¶8). Furthermore, rehabilitation is apparently a viable strategy. The Economist (US) (2006) states that since its ratification in November 2000, California’s Proposition 36, which allows drug offenders to complete rehabilitation programs in lieu of prison sentences, has caused the violent crime rate to decline more rapidly than the national average (p. 30, ¶ 6).     Since rehabilitation programs are far cheaper than imprisonment measures, successful rehabilitation programs allow community funds to be spent elsewhere; however, this is only one facet of this benefit. With an increase in rehabilitative measures, fewer prisons need to be built and maintained. As criminals are made, so are victims; reintroducing a criminal into society as a productive member of it allows society to experience less victimization.     As Cullen and Santana (2002) state, rehabilitation is still in its infancy. Little is known about how exactly to go about reforming certain individuals, and certainly reform must be based on each individual case. As more is learned about effective intervention, rehabilitation should grow as a form of punishment (p. 1325). Deterrence     Deterrence is defined by Macionis (2006) as “the attempt to discourage criminality through the use of punishment” (p. 182, ¶ 8). The idea is that if potential crimi ...
