First I will be explaining the legality of the death penalty. The States' declare is that demise is a necessary chastisement because it prevents the order of capital crimes more effectively than any less severe punishment. The first part of this claim is that the infliction of demise is necessary to stop the individuals executed from committing further crimes. (William Henry Furman v. State of Georgia, 408 U.S. 238) (1972). The court further stated that the capital punishment was not a form of harsh and rare punishment because the creators of the Bill of Rights from our Constitution would not have thought it to be harsh rare. Next I will be stating what my thesis is. The United States cannot claim to provide liberty and justice for all when its laws fail to care for innocent persons who are wrongfully committed of violating the law. Another topic I will write about is the view of the founding fathers. The methods of the death sentence were much more extreme than they are today, including crucifixion, drowning, thrashing, burning and impalement. It wasn't until the Tenth Century A.D., in Britain, that lynching became the usual method of execution.(Charlena Fuqua, 2007) I am sure everyone is wondering what is the Innocence Project and what is it about. This program is a public policy organization devoted to exonerating wrongfully accused people through DNA testing and to reform the criminal justice system to prevent potential injustices.(Innocence Project, 2006) Next I will be showing everyone the statistics of how many people have been wrongfully convicted of crimes they did not commit. Overall in the United States there have been 227 post-conviction from DNA exonerations. The year 1989 this was when the first DNA exoneration took place.
